Michael J. DiMaggio, Esq., devotes the bulk of his practice at CMG to the representation of more than twenty of the firm’s dietary supplement and sports nutrition clients. He provides these companies with the advice and guidance they need in order to remain compliant with FDA and FTC regulations.
Mike counsels clients on a variety of issues including regulatory matters such as introducing new dietary ingredients and supplement products to market, drafting supplement labels, advertising claim substantiation, adverse event reporting procedures, FDA inspection protocols and compliance with Good Manufacturing Practices (cGMPs) for dietary supplements. He also counsels clients on related business matters such as trademark and other intellectual property protection, manufacturing agreements, endorsement contracts and general business advice.
Mike is often contacted when a sports nutrition company is faced with an FDA Inspection, product recall, or legal crisis, such as the execution of a search warrant or the issuance of a subpoena for records and other information. He also regularly assists clients in responding to inquiries initiated by regulatory agencies or even competitors, such as through the Electronic Retailing Self Regulation Program (ERSP).
Mike has had his articles published in popular print and online health and fitness publications. He has also been interviewed by various national online and print publications, including The New York Times and USA Today. Mike is a graduate of Albany University with a Bachelor of Arts degree in Political Science. He received his Juris Doctor from St. John’s University School of Law and is admitted to the New York State Bar and the United States District Court for the Southern and Eastern Districts of New York. Mike is a member of the New York State Bar Association, and the Nassau County Bar Association.
Mike has served as the Executive Director of an organization dedicated to protecting consumer access to dietary supplements primarily by lobbying on Capitol Hill and organizing grassroots support.
He is also the former Finance Director for the Nassau County Democratic Party, where he helped raise over a million dollars in local contributions. Mike brings his political experience and extensive knowledge of sports supplements to Collins, McDonald & Gann as an associate in our Dietary Supplement Law and Sports Drug Defense practice areas.
